Resumo: The aim of this paper is to address the issue of the lack of retroactivity in the jurisprudence that creates rights, focusing on the jurisprudence simulated by the Supreme Courts. First, the jurisprudence as a fountain of rights will be addressed to compare the Civil Law and Common Law systems. Subsequently, it will also be compared to the Brazilian current Legal System providing examples of many judgments which will show the jurisprudence power of creating rights. Secondly, Legal Stability and Legal Confidence Protection principles will be treated in order to analyze the prospective over rolling to the jurisprudence. The historical effects of jurisprudence will always be treated regarding those principles in order to clarify that it is neither fair nor reasonable to allow the lack of retroactivity only in law rather than in jurisprudence, since the latter is responsible for making the meaning, the content and the access to justice possible for people.

A jurisprudência como fonte do direito é abordada primeiramente em comparativo dos sistemas da civil law e comonn law e, posteriormente de acordo com que se tem verificado no ordenamento jurídico brasileiro atual, com indicação para o poder criador da jurisprudência, através de exemplo de vários julgados. Firmada a jurisprudência como fonte de direito, porque criadora deste, os princípios da segurança jurídica e da proteção da confiança legítima são tratados com vistas a permitir a análise da viabilidade de se conferir efeitos prospectivos a determinadas súmulas.
