Resumo: The present study’s subject of the establishment of a legal interpretation in the incident of the resolution of multiple claims in Brazilian legal system. In this sense, the work will begin by analyzing the stare decisis system and, then, it will analyze the differences regarding the etablishment of precedent in the stare decisis compared to the Brazilian system. After that, the study will analyze the peculiarities of the IRDR. Following, the study will turn to the analysis of the institute of supercedents, as opposed to subprecedents, to verify what should be avoided when forming the legal interpretation from the perspective that the legal interpretation should be established as a court management mechanism. Then, the work will present parameters for the establishment of the legal thesis in attention to procedural efficiency and court management. Next, the study will turn to the development of the reight to be hard principle in the establishment of the legal thesis, in order to allow the debate to comprehend all particularities evolving the controversial legal issue aiming to be as complete as possible. Finally, this dissertation will analyze judgments of incidents of the resolution of multiple claims in attention to the parameters proposed in this work.

Nesse sentido, o trabalho iniciará pela análise do sistema de precedentes do stare decisis, para, então, analisar as diferenças quanto à formação do precedente no stare decisis do common law em comparação ao sistema de brasileiros para, em seguida, analisar as peculiaridades do IRDR. Em seguida, a partir da perspectiva de que a tese jurídica deve ser formada como mecanismo de gestão processual, o estudo voltar-se-á à análise do instituto dos superprecedents, em contraposição aos subprecedents, para verificar o que se deve evitar ao formar a tese jurídica. Então, o trabalho apresentará parâmetros para a formação da tese jurídica em atenção a eficiência processual e melhor gerenciamento do tribunal. Em seguida, o estudo voltar-se-á ao delineamento do princípio do contraditório na formação da tese jurídica, com vias a permitir o esgotamento do debate em torno da questão jurídica controvertida.
