Resumo: This dissertation aims to investigate the operationalization of the state of exception to fundamental and human rights in the field of criminal justice. To this end, the objective was to analyze the power in times of social abnormality, such as in wars and colonial occupations, in order to verify how remnants of this same power (war power) materialize in the Democratic State of Law. The advance of the police state in relation to blacks, as a manifestation of sov-ereign power, drives the emergence of a counter power, through criminal law interpreted with other assumptions of legitimacy and that affirms the purposes already inserted in the political constitution. In this way, we propose a criminal law oriented under a racial perspective, having as a reference the Inter-American Convention against Racism, Racial Discrimination and Related Forms of Intolerance, which entered the legal system in 2022 with constitutional norm status.

Para tal, objetivou-se analisar o poder em tempos de anormalidade social, tais como em guerras e ocupações coloni-ais, para verificar como resquícios deste mesmo poder (poder bélico) se concretiza no Estado Democrático de Direito. O avanço do Estado de polícia em relação ao negro, como manifesta-ção do poder soberano, impele a emergência de constituir-se um contrapoder, através de um direito penal interpretado com outros pressupostos de legitimidade e que afirmem os propósi-tos já inseridos na Constituição política.
