Resumo: This study aims to examine the controversies surrounding the application of Article 200 of the Civil Code of 2002. Since it is a legal device that was not set forth in the previous Civil Code, there are no defined parameters for the implementation of the aforesaid Article 200, which generates wide divergence among the Courts, including the Supreme Court. Starting from a functional analysis of prescription and considering the purpose of the device in question, which is inserted among the rules governing the intercommunication between civil and penal spheres, our objective is to provide the elements for the correct interpretation and application of Article 200 of the Civil Code of 2002 to cases.
