This thesis aims to provide technical and theoretical support to update design laws, practices and intellectual property protection policies. To this end, conjectures are drawn that exemplify directions to whereIntellectual Property rights relating to design may be headingin Brazil, especially considering the changes in contemporary industrial production. Realizing a temporal movement towards both past and future, the research also executes a movement of epistemic territorialisation, bringing this debate, usually carried out by jurists and researchers in law or economics, to the theoretical field of design. Topics covered include the emergence of design laws in countries such as France and England throughout the 18th and 19th centuries; the development of industrial design protection laws in Brazil in the 19th and 20th centuries, and, in parallel, the national institutionalization of the field of design. It also takes a critical look at the current state of industrial design protection, the actualIndustrial Property Law, its requirements and examination criteria. Finally, this thesis presents a fictional exercise of conjectures, addressing issues such as additive manufacturing, industry 4.0, artificial intelligence, and the growing importance of interaction design in what has been called the fourth industrial revolution.
