Geographic Indications: a survey of records granted and in progress with the National Institute of Industrial Property (1999-2021)

Resumo: The legal framework for Geographical Indications (GIs) in Brazil came about through the enactment of Law No. 9,279/96, which regulates the rights and obligations on industrial and intellectual property in the country. In this scenario, the purpose of the study was to carry out a survey of the GIs, in the Indication of Origin (IP) and Denomination of Origin (DO) modalities, registered and the requests in progress with the National Institute of Industrial Property, in the period between 1999 to 2021. It is a bibliographical and exploratory research, in which a survey of requests for GI in Brazil was carried out, analyzing them by Brazilian regions and by federative units. The results indicate that of the 26 states plus the Federal District, 97 GI records were recorded by the year 2021, of which 68 are IPs, all national, and 29 are DOs, of which nine are foreign. Finally, as for registration requests, almost 80% are for IP recognition.

Nesse cenário, a finalidade do estudo foi realizar o levantamento das IGs, nas modalidades Indicação de Procedência (IP) e Denominação de Origem (DO), registradas e os pedidos em andamento junto ao Instituto Nacional da Propriedade Industrial (IMPI), no período compreendido de 1999 a 2021. É uma pesquisa bibliográfica e exploratória, na qual se realizou levantamento dos pedidos de IG no Brasil, analisando-as por regiões brasileiras e por Unidades Federativas. Os resultados apontam que, dos 26 estados mais o Distrito Federal, contabilizou-se 97 registros de IGs até o ano de 2021, dos quais 68 são IPs, todas nacionais, e 29 são DOs, das quais nove são estrangeiras.
