Technology Transfer Under the Optics of the Innovation Policy and the Legal Milestone of Science, Technology and Information

Resumo: Transfer technology is one way of establishing partnerships between universities and companies, but it is a complex process for both actors. From the point of view of the university, the objective of this work was to present an analysis of the Innovation Policies regarding the applicability of the current innovation laws about the transfer technology from Research Institutions to companies. The methodology used in this work was an exploratory research and documentary analysis. The Technological Innovation Policies already approved by the Institutions Councils belonging to three Brazilian Science and Technology and Innovation Institutions (ICT), named ICTs 1, 2 and 3 were analyzed. It was verified the lack of applicability of the legislation in force in the Innovation Policies Approved. It is recommended that in future studies the impacts of these partnerships be analyzed based on the Law of the Legal Framework of Science, Technology, and Information.

Do ponto de vista das Instituições, o objetivo deste trabalho é apresentar uma análise das Políticas de Inovação quanto à aplicabilidade das leis de inovação vigentes, no que se refere à transferência de tecnologia das Instituições de Pesquisa para as empresas. A metodologia utilizada neste trabalho foi a de pesquisa exploratória e análise documental. Foram analisadas as Políticas de Inovação Tecnológica já aprovadas pelos Conselhos Superiores, pertencentes a três Instituições de Ciência e Tecnologia e Inovação (ICT) do Brasil, denominadas de ICT 1, 2 e 3. Constatou-se a pouca aplicabilidade das legislações vigentes nas Políticas de Inovação Tecnológica aprovadas.
