Legal Instruments of the Legal Framework of Science, Technology and Innovation: study of 2020 technology transfer contract models of the Attorney General's Office

In 2020, the Attorney General's Office (AGU) published the "Collection of Legal Opinions and Instruments of the Legal Framework for Science, Technology and Innovation". Starting from the analysis of the drafts that involve Technology Transfer, the objective of this work was to analyze clauses liable to generate conflicts, given the complexity of these transactions. The work methodology consisted of literature review, identification of contractual instruments proposed by AGU, reading and detailed analysis of documents, qualitative analysis and identification of sensitive points related to Intellectual Property and Technology Transfer in the respective contractual models. As a result, points such as the use of the contractor's name, technological developments that took place during the term of the contract, and the use of the know-how nomenclature are analyzed in the light of the legislation, anticipating possible conflicts between the parties and contributing to the discussions on the subject in the country.
