Registration of Trademarks Containing Flags and Monuments: a temporal analysis of administrative decisions made by the INPI

The registration of trademarks grows every year in Brazil. Item I of article 124 of the Industrial Property Law establish that cannot be registered as a mark neither flags nor monuments, however, these symbols are very used in sectors of the economy such as cosmetics, language courses and food. This work did an analysis, over the years, of the trademarks applications rejected by item I of article 124 of the LPI. The methodology used was exploratory, using bibliographical research, and quantitative analysis. These analyzes were about the presentation of the rejected trademark, the nature of the trademark, the class of the trademark application, the reason for the rejection (flag or monument), the type of applicant, if the applicant had an attorney, the applicant's profile, if there was an appeal by the applicant. Generating results and discussions on this subject that can be used for future research.
