Copyright and Education: the use of cinematographic works for educational purposes

This article discusses the use of cinematographic works in educational establishments in the face of copyright rules. It conceptualizes copyright and brings up the protection, in Brazil, conferred by Law n. 9.610/98 to intellectual works, especially to cinematographic works, given that these are perceived as powerful tools for the development of the teaching-learning process. It also presents exceptions contained in international diplomas, inherent to the use of cinematographic works for educational purposes. It points out that, as a rule, the use of cinematographic works in educational institutions depends on the prior and express authorization of the author of the work. The methodology followed a qualitative approach, with exploratory objectives. Bibliographic and documental research, consultations with public bodies, analysis of regulations and electronic pages related to the theme were carried out. Based on the results achieved, it is proposed to amend Law n. 9.610/98, in order to expressly contemplate the use of cinematographic works in educational establishments.
