NEGOTIATE LIFE? collective bargaining during the pandemic in Brazil

Resumo: This paper analyzes how the union movement faced the challenges imposed by the Covid-19 pandemic, investigating the collective bargaining that took place between March 2020 and early 2021. Its core question inquires: have unions been able to build webs of protection for their members, in the form of collective norms agreed upon with employers? A pertinent question, since the 2017 labor reform immensely weakened the capacity of organized labor to act, by ending the union tax and limiting collective bargaining to consensual forms of funding, thereby impoverishing unions; and by reducing the scope of issues subject to collective bargaining, which was aggravated by the federal provisional measures aimed at facilitating the business response to the crisis, at the expense of workers’ income. The empirical research is based on collective bargaining results from four categories of essential workers: food and supermarket retailers, nurses, truck drivers, and bank clerks.

La pregunta a responder es: ¿los sindicatos pudieron construir redes de protección para sus representados, en forma de normas colectivas acordadas con los patrones? Su relevancia radica en que la reforma laboral de 2017 debilitó la capacidad de acción de los sindicatos, al acabar con el impuesto sindical y limitar la negociación de formas consensuadas de financiamiento; y al reducir el alcance de los temas de negociación, agravado por las medidas provisionales del gobierno, destinadas a facilitar la respuesta patronal a la crisis, en detrimento de los ingresos de los trabajadores. El estudio presenta los resultados de la negociación de trabajadores del comercio del sector de alimentos y supermercados, enfermeras, camioneros y empleados bancarios.Cette étude évalue comment le mouvement syndical a répondu aux défis de la crise sanitaire, ayant pour objet les négociations collectives qui se sont déroulées entre mars 2020 et début 2021. La question centrale à laquelle il faut répondre est : les syndicats parviennent-ils à construire des toiles de protection pour ceux qu’ils représentent, sous la forme de normes collectives convenues avec les patrons ? La question est pertinente car la réforme du travail de 2017 a immensément affaibli la capacité d’action des travailleurs organisés, en supprimant la taxe syndicale et en limitant la négociation collective des formes consensuelles de financement, appauvrissant ainsi les syndicats ; et en réduisant le champ des sujets soumis à la négociation collective, ce qui a été aggravé par les mesures provisoires du gouvernement fédéral, visant à faciliter la réponse des hommes d’affaires à la crise, au détriment des revenus des travailleurs. L’étude empirique est basée sur les résultats des négociations collectives de quatre catégories de travailleurs essentiels : les commerçants de l’alimentation et des supermarchés, les infirmières, les camionneurs et les employés de banque.Este estudo busca avaliar como o movimento sindical respondeu aos desafios da crise sanitária, tendo como objeto as negociações coletivas ocorridas entre março de 2020 e inícios de 2021. A pergunta central a ser respondida é: os sindicatos conseguiram construir teias de proteção para seus representados, na forma de normas coletivas pactuadas com os patrões? A pertinência da pergunta decorre de que a reforma trabalhista de 2017 fragilizou imensamente a capacidade de ação do trabalho organizado, ao acabar com o imposto sindical e limitar a negociação coletiva de formas consensuais de financiamento, com isso empobrecendo os sindicatos; e ao reduzir o escopo dos temas passíveis de negociação coletiva, algo agravado pelas medidas provisórias do governo federal, voltadas para facilitar a resposta dos empresários à crise, à custa da renda dos trabalhadores.
