Resumo: | In this article, we analyze the systemic violence that the juridical system exerts on intersex people, by situating them in what has been proposed as a bio-state of exception. This naturalizes sexual binarism and imposes it by means of the suspension of rights. To approach this situation, we propose the consideration of non-consensual medical treatments against intersex people as analogous to crimes against humanity and the need to build a right to self-determination of bodies. |

Este naturaliza el binarismo sexual y lo impone por medio de la suspensión de derechos. Para salir de esta situación, se propone considerar los tratamientos médicos no consentidos contra las personas intersex como análogos a los crímenes contra la humanidad y la necesidad de construir un derecho a la libre autodeterminación de los cuerpos.Neste artigo analisamos a violência sistêmica que o sistema jurídico exerce sobre as pessoas intersexo, situando-as no que tem sido proposto como um bioestado de exceção. Isso naturaliza o binarismo sexual e o impõe através da suspensão dos direitos.
