Resumo: The present study analyzes the working relationship of the new segment of drivers by smartphone applications and the UBER technological platform, since it has been verified the presence of assumptions that characterize an employment relationship, even though they are formally governed by a civil contract. . Through bibliographic research of books, scientific articles and journals, we seek to understand the changes that occurred in employment relationships with the implementation of new technologies and their impact on the configuration of the assumptions that characterize this link. It is investigated, through the jurisprudential study, how the specialized Brazilian Courts have decided on the object of study of this work. The research adopts the inductive method to conclude the absence of consonance between the Regional Labor Courts regarding the analysis of each specific case that deals with the employment relationship between drivers and the UBER platform, which is why it is suggested, in order to avoid the suppression of constitutional rights already conquered, the in-depth study of the theme by the Public and Judicial Authorities.

Busca-se, por meio da pesquisa bibliográfica de livros, artigos científicos e periódicos compreender as mudanças ocorridas nas relações de emprego com o implemento de novas tecnologias e o impacto delas na configuração dos pressupostos caracterizadores deste vínculo. Investiga-se, por meio do estudo jurisprudencial, como os Tribunais Pátrios especializados têm decidido sobre do objeto de estudo deste trabalho.
