Eutanásia e sua aplicação no direito brasileiro

Resumo: The present work search to establish a study on the euthanasia, analyzing the variants in the application of the institute in the daily. In that focus, the monograph puts historical aspects of the institute, it establishes the euthanasia species. Besides, it tries to show the existence of the subject before the several religions and the application while institute of the right in the alien countries and in Brazil. Also she tried to show the report of several cases of euthanasia, besides bringing examples of places where she is already an appealing reality, and in others that, although it is prohibited expressly, what there is, in practice, it is his current use, showing the experience that is better a combined legal regulation to exist the an understanding of the society, in way to execute the beginning of the human person's dignity in the incurable patient's illustration. Through vast bibliographical research, the present study seeks to meditate on the controversial theme of the euthanasia, that always woke up heated discussion through the times, as well as the abortion and the death penalty, themes that never stop being current.

Nesse enfoque, a monografia coloca aspectos históricos do instituto, estabelece as espécies de eutanásia. Além disso, procura-se mostrar a existência do assunto perante as diversas religiões e a aplicação enquanto instituto do direito nos países alienígenas e no Brasil. Também se procurou mostrar o relato de vários casos de eutanásia, inclusive trazendo exemplos de lugares onde ela já 6 uma realidade recorrente, e em outros que, embora seja expressamente proibida, o que há, na pratica, e a sua utilização corriqueira, mostrando a experiência que o melhor existir uma regulamentação legal combinada a uma conscientização da sociedade, de forma a efetivar o princípio da dignidade da pessoa humana na figura do enfermo incurável.
