Resumo: This dissertation aimed to understand the representations of social actors Leisure transiting within the specialized institutions that care for people with disabilities in order to understand if / how to establish education initiatives by / to the Leisure, as well as appropriations of phenomenon as social law. The survey was conducted in three institutions specialized in assisting this group at Vitória city / ES. The subjects were the leaders (representatives) of the institutions and people with disabilities served by the same (both on a voluntary basis). For the first phase of the study, was used as a tool to semi-structured interview and the second phase, the instrument for the documents analysis of the institutions and the actions of Public Policy Sports and Leisure (PPEL) in Vitória / ES was a framework for content analysis. We decided then to this research, a qualitative methodological approach, using the phenomenological method to interviews and content analysis for all data collected. To achieve the purpose of this study, was necessary structure of the theoretical discussions of who clarified a rule that leads to full citizenship, as well as a discussion of how this can be confirmed through the Social Rights and Public Policy. By placing the reader into these categories, we started to discuss not only the leisure, but this law influences at human development beings and the importance of inclusion by / at leisure, as well as possible ways that this can be achieved. Data analyses indicate that institutions much as they worry about citizenship and work, in many instances do not see as their duty education for the Leisure appropriation as a social law, thus affecting the way this right and everything that the fence is working or not for them. The attitude often inertia on the part of specialized institutions is of no influence PPEL regarding the inclusion of an effective way. You can still see that generally, people with disabilities tend to experience a limited Leisure, due to attitudinal, physical, but mainly economic impediments. The limited experience is added the lack of preparation and professional environments that will receive them, as well as knowledge of their own right. People with disabilities also have a nascent understanding the concept of public policy, leading to a very limited view about the right to leisure and even the lives of ourselves, this is sometimes influenced by the view of institutions, as they realize the Leisure a functional issue, or even media that preaches Leisure as synonymous with the sport of income. These findings emphasize the importance of establishing a specific education on the question of rights beyond civil rights, the right to participate and who will claim the right political and social, which includes the Recreation, and institutions play a role-key in this process, not just exercising their role as citizens, but mainly as organic intellectuals of Civil Society. It follows that education must go beyond the walls of the formal school, entering the popular places of intervention in society, including institutions of care people with disabilities.

A pesquisa foi realizada em três instituições especializadas no atendimento a este grupo, na cidade de Vitória/ES. Os sujeitos foram: os dirigentes (representantes) das instituições e as pessoas com deficiência atendidas pela mesma (ambos de forma voluntária). Para a primeira fase do estudo, foi utilizada como instrumento a entrevista semiestruturada, e para a segunda fase, o instrumento para a análise dos documentos das instituições e das ações de Políticas Públicas de Esporte e Lazer (PPEL) da cidade de Vitória/ES, foi um quadro de análise de conteúdo. Optou-se então para esta pesquisa, uma metodologia de abordagem qualitativa, com utilização do método fenomenológico para as entrevistas e análise de conteúdo para todos os dados coletados. Para o alcance da proposta deste estudo, tornou-se necessária uma estrutura de referencial teórico que clareasse as discussões de um Estado que leve a uma Cidadania Plena, assim como uma discussão sobre como esta pode ser ratificada por meio dos Direitos Sociais e das Políticas Públicas. Ao situar o leitor nestas categorias, passou-se a discutir não apenas o Lazer, mas como este direito influencia no desenvolvimento do ser humano e a importância da inclusão pelo/no Lazer, assim como os meios possíveis para que isto possa ser alcançado. As análises dos dados apontam que as instituições por mais que digam se preocupar e trabalhar a cidadania, em muitos momentos não veem como sendo seu dever a educação para a apropriação do Lazer como um Direito Social, afetando assim a forma como este direito e tudo o que o cerca seja trabalhada ou não pelas mesmas. A postura muitas vezes de inércia por parte das instituições especializadas acaba por não influenciar as PPEL no que se refere a uma inclusão de forma efetiva. Pode-se perceber ainda que geralmente, a pessoa com deficiência tende a uma vivência limitada de Lazer, devido a impedimentos atitudinais, físicos, mas principalmente econômicos. A esta vivência limitada se agrega a falta de preparo dos ambientes e dos profissionais que irão recebê-los, assim como do conhecimento de seu próprio direito. As pessoas com deficiência possuem ainda uma compreensão incipiente sobre o conceito de Políticas Públicas, levando a uma visão limitada sobre o próprio direito ao Lazer e até as vivências dos mesmos, esta situação por vezes é influenciada pela visão das instituições, que percebam o Lazer como uma questão funcional ou até mesmo midiática que prega o Lazer como sinônimo do esporte de rendimento. É notória a importância de estabelecer uma educação específica na questão de direitos para além do civil, no direito que levará à participação e reivindicação do direito político e social, no qual se inclui o Lazer, e as instituições desempenham um papel fundamental neste processo, não apenas exercendo sua função como cidadãos, mas principalmente como intelectuais orgânicos da Sociedade Civil.
