Legitimidade da representação em conselhos de saúde : o caso do Conselho Municipal de Saúde de Vitória-ES

Resumo: The Public Policies Management Councils emerged on the Brazilian scene with the 1988 Federal Constitution, which enshrined the social participation principle in various constitutional provisions. Thus, the Brazilian legal system has set up an hybrid institutional architecture, in that it focuses on the combination of representation and social participation. The latter, provided via management councils, put into play a new theoretical problem whose focus is the relationship between representation and participation, because the theoretical debate tends to focus on representation (representative democracy) or participation (Participatory Democracy). In this debate, both appear as separate constitutive forms of different models of democracy. However, this dualization has overlooked an essential dimension in terms of participatory experiences with regard to how to structure the processes of representation in participatory spaces. The premise of this study, therefore, is that both ideas are complementary, not antithetical. From there, we seek to ascertain in the Municipal Health Council of Vitoria, Espirito Santo, how the relationship between representatives and represented occur through a process that is being considered, by the recent literature, as determining the legitimacy of this relationship: authorization and accountability. This is a qualitative research, featured as a case study where we used the technique of the Collective Subject’s Discourse – DSC – to organize the interviews in order to map, therefore, some political networks built within the Council, in order to show how legitimate is the representation relationship between civil society’s counselors and their respective entities. The results show some limits to representation in the studied Council with a clear distance between the representative and its political base. However, some progress could also be observed. Some statements showed an attempt by some subjects in order to catch up with their entities and these, in turn, charge their representatives the return required to occur the legitimate representation. These findings do not suggest anything more than the obvious need to undertake further studies on this topic.

These findings do not suggest anything more than the obvious need to undertake further studies on this topic.Os conselhos gestores de políticas públicas emergiram no cenário brasileiro a partir da Constituição Federal de 1988, que consagrou o princípio da participação social em diversos dispositivos constitucionais. Com isso, o ordenamento jurídico brasileiro passou a configurar uma arquitetura institucional híbrida, na medida em que privilegia a combinação entre representação e participação social. Esta última, assegurada via conselhos gestores, colocou em cena uma nova problemática teórica cujo foco recai na relação entre representação e participação. Isto porque o debate teórico tende a privilegiar ou a representação (Democracia Representativa) ou a participação (Democracia Participativa). Neste debate, ambas aparecem separadas enquanto formas constitutivas de modelos diferenciados de democracia. Porém, essa dualização tem desconsiderado uma dimensão essencial no que tange as experiências participativas que diz respeito à forma como se estruturam os processos de representação no interior dos espaços de participação. A premissa deste estudo, portanto, é a de que ambas as idéias são complementares, não antitéticas. A partir daí, buscamos averiguar no Conselho Municipal de Saúde de Vitória, Espírito Santo, como se efetuam as relações entre representantes e representados através de processos que vem sendo considerados, pela literatura recente, como determinantes da legitimidade desta relação: autorização e prestação de contas. Trata-se de um estudo de caso, com abordagem qualitativa, em que utilizou-se a técnica do Discurso do Sujeito Coletivo DSC para a organização das entrevistas visando mapear, portanto, algumas redes de articulações políticas, construídas no âmbito do Conselho, a fim de se evidenciar o quão legitimas são as relações de representação entre conselheiros da sociedade civil e suas respectivas entidades. Os resultados evidenciam alguns limites à representação no conselho estudado com evidente distanciamento entre o representante e sua base. Porém, alguns avanços também puderam ser observados em discursos que mostraram uma tentativa de alguns sujeitos de se aproximarem de suas entidades e estas, por sua vez, cobrarem dos seus representantes o retorno necessário para que a representação ocorra legitimamente.
