Captive Audience Speech in the Brazilian Labor Law.

Resumo: Anti-union speech to a captive audience is legally possible in the USA, which is, notwithstanding, far from the reality of the labor legislation in Brazil. It cannot be examined under the same scope, as the reality of Brazilian labor doesn’t reproduce the same conditions. In fact, it must be examined considering the power of command employers possess under a labor contract and the limits imposed therein. The Brazilian labor courts have been very rigid on the subject, imposing important limitations to employers’ practices and severely punishing their iniquity. That doesn’t mean, however, that speeches to captive audience are totally blocked. They would be possible in very specific contexts, such as those related to empowering the workforce and building a safe working environment.
