Resumo: | For decades, the process of demarcating indigenous lands has been an effective tool in implementing the constitutional right to land for indigenous peoples in Brazil. However, the current scenario reveals a landscape marked by difficulties and delays in the delineation and recognition of indigenous lands. As a result, self-demarcation emerges as a non-state alternative proposal capable of realizing the territorial claims of indigenous peoples in Brazil. This research aims to analyze the feasibility of self-demarcation in light of the deterioration of indigenous territorial rights. The hypothesis raised is that, with the halt of state land demarcation processes, self-demarcation arises as a reliable alternative for the realization of indigenous territorial rights in Brazil. In this study, a qualitative method was applied, using the dialectical technique of law, as well as the analysis of data related to the state land demarcation process. |

No entanto, o cenário atual revela um cenário marcado por uma dificuldade e morosidade na delimitação e reconhecimento de terras indígenas. Com isso, a autodemarcação surge como uma proposta alternativa não estatal capaz de concretizar as reivindicações territoriais dos povos indígenas no Brasil. Esta pesquisa tem como objetivo analisar a viabilidade das autodemarcações diante da precarização do direito à terra dos povos indígenas. A hipótese levantada é que, com a obstacularização dos processos estatais de demarcação de terras, a autodemarcação surge como uma alternativa confiável para o cumprimento do direito à terra dos povos indígenas no Brasil.
