ETHNIC-RACIAL QUOTAS AT UNIVERSITIES AND LAW PARADIGMS: A REFLECTION ON THE IMPLEMENTATION OF RACIAL HETERO-IDENTIFICATION COMMISSIONS

Resumo: The article deals with ethnic-racial quotas, based on a black critique of hermeneutics that understands structural and institutional racism, as well as the relationships of inequalities in cultural and social status in the dialogue with the Judiciary. In this process, the hermeneutic phenomenology is used, starting from a literature review, as well as the study of the concept of legal-democratic revolution. In this process, an interpretation of the votes in the Action for Non-Compliance with the Fundamental Precept 186 is proposed in order to understand the conflicts over the recent implementation of the racial hetero-identification Commission. Judicialization.  El artículo trata de las cuotas étnico-raciales, a partir de una crítica negra a la hermenéutica que incluye el racismo estructural e institucional, así como las relaciones de desigualdades culturales y de estatus social en el diálogo con el Poder Judicial. En este proceso se utiliza la fenomenología hermenéutica, a partir de una revisión bibliográfica, así como del estudio del concepto de revolución legal-democrática. En este proceso, se propone interpretar los votos en la Acción por Incumplimiento del Precepto Fundamental 186 a fin de comprender los conflictos por la reciente implementación de la comisión de heteroidentificación racial.  PALABRAS CLAVE:  Cuotas Étnico-raciales. Judicialización.  O artigo trata das cotas étnico-raciais, a partir de uma crítica negra da hermenêutica que compreende o racismo estrutural e institucional, assim como as relações de desigualdades de status cultural e social na interlocução com o Poder Judiciário. Nesse processo, utiliza-se a fenomenologia hermenêutica, partindo de revisão bibliográfica, assim como o estudo sobre o conceito de revolução jurídico-democrática. Nesse processo, propõe-se interpretação dos votos na Ação de Descumprimento ao Preceito Fundamental 186 com fins de entendimento dos conflitos sobre a recente implementação da comissão de heteroidentificação racial.
