Resumo: O presente trabalho tem por objetivo destacar o papel do habeas corpus como garantia constitucional na proteção do direito fundamental de ir e vir, analisando, principalmente, eventuais limitações que este remédio heroico possa estar sofrendo quanto à restrição de sua utilização, notadamente em substituição ao manejo do Recurso Ordinário Constitucional.
