Due diligence as a mechanism to strengthen respect for labour human rights in Latin America

Resumo: Despite the potential economic and social positive impact of transnational corporations, their activities in Latin America often pose a challenge to the full enjoyment of labor human rights. The countries of this region face a growing number of situations of forced labor, child labor, job insecurity or discrimination in the workplace. Against this background, this paper analyses the extent to which the implementation of mandatory human rights due diligence may be an efficient mechanism to strengthen respect for labor human rights in the context of business activities in Latin America. In this sense, this paper explores how the Inter-American Human Rights System promotes the implementation of due diligence mechanisms by businesses as well as the adoption of legislative initiatives at the national level.

Los países de la región presentan preocupantes datos en relación con aspectos como el trabajo forzoso, el trabajo infantil, la seguridad laboral o la discriminación en el entorno de trabajo. En este contexto, este artículo trata de analizar en qué medida la implementación de la diligencia debida empresarial obligatoria puede convertirse en un mecanismo eficiente para fomentar el respeto de los derechos humanos laborales en el contexto de las actividades empresariales desarrolladas en América Latina. Para dar respuesta a esta pregunta, se estudia de qué manera el Sistema Interamericano de Derechos Humanos promueve la aplicación por parte de los Estados de mecanismos de diligencia debida, así como distintas iniciativas legislativas a nivel nacional.Apesar do potencial impacto positivo em nível econômico e social, as atividades da empresas transnacionais que operam na América Latina muitas vezes representam um desafio ao pleno gozo dos direitos humanos trabalhistas. Os países da região apresentam dados preocupantes em relação à aspectos como trabalho forçado, trabalho infantil, segurança no emprego ou discriminação no ambiente de trabalho. Nesse contexto, este artigo procura analisar em que medida a implementação da due diligence empresarial obrigatória pode se tornar um mecanismo eficiente para promover o respeito aos direitos humanos trabalhistas no contexto das atividades empresariais desenvolvidas na América Latina.
