The nursing team and its knowledge about legal attributions

Resumo: This study aims to verify the knowledge of the nursing team about its legal attributions according to LEPE - Law nº 7,498/86 of Professional Exercise and Decree n º 94,406/87. Between March and June, 2008, a semi-structured questionnaire was used to evaluate nursing professional who worked in Health Care Units located in the city of Palmitos - SC. Data were individually collected in the workplace and all participants remained anonymous and were free to participate. The questionnaire was composed by 35 items regarding legal attributions of the nursing team according to LEPE, and was answered by 17 professionals (100%), including nursing assistants, nursing technicians and nurses. Results suggest that the nursing team has to be constantly reminded or re-reminded of its individual attributions since 48% of the questions were incorrectly answered. We understand that having an adequate knowledge about such attributions is essential to diminish differences and occupational hazards and provide a qualified and effective care to the population, ensuring the legality of the team's actions.

El método utilizado fue la aplicación de un cuestionario semiestructurado sobre el asunto investigado. Los datos fueron recogidos por separado en el ambiente laboral del equipo; se preservó el anonimato de los participantes, que tuvieron libertad para participar o no en el estudio. El instrumento de investigación se componía de 35 (treinta y cinco) competencias del personal de enfermería según las necesidades de la LEPE. El cuestionario fue respondido por 17 (diecisiete), es decir, el 100% del equipo de profesionales incluyendo auxiliares, técnicos de enfermería y enfermeras. Los resultados del estudio sugieren que al personal de enfermería se le debe recordar constantemente sus tareas individuales; se señala dicho punto porque del total de preguntas y tareas, 48% fue respondido incorrectamente. Se entiende que el conocimiento de sus habilidades hace que el equipo tenga más familiaridad con sus deberes, reduciendo las diferencias y riesgos profesionales, proporcionándole a la población atención eficaz y calificada y otorgándole legalidad a las acciones de los profesionales del equipo.O propósito com este estudo foi verificar o conhecimento da equipe de enfermagem sobre suas atribuições legais segundo a Lei do Exercício Profissional (LEPE) nº 7.498/86 e o Decreto nº 94.406/87, em unidades de saúde do município de Palmitos-SC, no período de março a junho de 2008. O método utilizado foi a aplicação de um questionário semiestruturado relacionado ao assunto investigado. Os dados foram coletados individualmente no próprio ambiente de trabalho da equipe, sendo que os participantes permaneceram em anonimato e livres para participar ou não do estudo. O instrumento de pesquisa era composto por 35 atribuições da equipe de enfermagem, conforme previsto na LEPE. O questionário foi respondido por 17 profissionais, ou seja, 100% da equipe, dentre eles auxiliares, técnicos de enfermagem e enfermeiros. Os resultados da pesquisa sugerem que a equipe de enfermagem tem de ser constantemente lembrada e/ou relembrada de suas atribuições individuais, tendo em vista, da totalidade das perguntas/atribuições, 48% foram respondidas incorretamente.
