Between moral philosophy and the law: moral, political and legal constructivism embedded in The Right to Justification: elements of a constructivist theory of justice

Resumo: The present paper focus on the book The Right to Justification: elements of a constructivist theory of justice, by Rainer Forst. Given that a theory of justice sheds a pertinent light on law, this article aims to present how the basic human right to justification presents itself in moral, political and legal contexts, in order to explain how such contexts of justification are interconnected in the aforementioned work. This objective is justified if we understand that a theory of justice is a necessary normative feature of a legal theory aimed at justified and legitimate disputes resolution. To achieve this goal, to visualize a theory of legal legitimacy in Forst, this work specifically aims: i) to present the general characteristics of The Right to Justification philosophical enterprise; ii) to characterize its moral constructivism, with special focus on how the latter is connected to a conception of human rights and iii) to make explicit  how this moral constructivism is intertwined with political and legal constructivism. From this, the following thesis is sustained: for Forst, law is the language of moral and political discourses, as well as a state order constituted and legitimized through the institutionalization of the individual moral rights. At the end, it is expected to show the relevance of developing a legal theory sensitive to questions of justice, and of developing a theory of justice sensitive to Law as an order by which it can be realized.

At the end, it is expected to show the relevance of developing a legal theory sensitive to questions of justice, and of developing a theory of justice sensitive to Law as an order by which it can be realized.El objeto de investigación de este artículo es la obra The Right to Justification: elements of a constructivist theory of justice, de Rainer Forst.  Considerando que una teoría da la justicia arroja una luz pertinente sobre el derecho, este artículo tiene como objetico presentar como él derecho humano básico a la justificación se manifiesta en contextos morales, políticos y jurídicos, a fin de explicar cómo tales contextos de justificación se interconectan en la obra mencionada. Este objetivo se justifica si entendemos que una teoría de la justicia es un elemento normativo necesario para una teoría del derecho encaminada a la resolución justificada y legítima de los conflictos. Para lograr este fin, visualizar una teoría de la legitimidad jurídica en Forst, los objetivos específicos del trabajo son: i) presentar las características generales de lo empresa filosófica de la obra en análisis; ii) caracterizar su constructivismo moral, con atención a su vínculo con una concepción de los derechos humanos, y iii) explicar la forma en que este constructivismo moral se entrelaza con el constructivismo político y jurídico. A partir de ello, se sustenta la tesis: para Forst, el Derecho es el lenguaje de los discursos morales y políticos, así como un orden estatal constituido y legitimado por la institucionalización de los derechos morales individuales. Al final, se espera demostrar la pertinencia de desarrollar una teoría del derecho sensible a las cuestiones de justicia, y una teoría de la justicia sensible a las especificidades del Derecho como la orden que puede implementarlo.O objeto de investigação do presente artigo é a obra The Right to Justification: elements of a constructivist theory of justice, de Rainer Forst. Tendo em vista que uma teoria da justiça lança uma pertinente luz sobre o Direito o presente artigo tem por objetivo apresentar como o direito humano básico à justificação se manifesta nos contextos moral, político e jurídico, de forma a explicitar como tais contextos de justificação se interconectam na referida obra.  Esse objetivo se justifica se compreendermos que uma teoria da justiça é um elemento normativo necessário a uma teoria do Direito voltada à resolução justificada e legítima de conflitos. Para a consecução desse fim, de visualizar uma teoria da legitimidade jurídica em Forst, são objetivos específicos do trabalho: i) apresentar as características gerais do empreendimento filosófico da obra em análise; ii) caracterizar seu construtivismo moral, com atenção a seu vínculo com uma concepção dos direitos humanos e iii) explicitar a maneira pela qual esse construtivismo moral se entrelaça com os construtivismos político e jurídico. A partir disso, sustenta-se como tese: para Forst, o Direito é a linguagem dos discursos morais e políticos, bem como uma ordem estatal constituída e legitimada pela institucionalização dos direitos morais individuais.
