The supralegality of international treaties on human rightsm in perspective: reflections of different hierarchies in Brazilian legal order

Resumo: | Brazil expresses before the international society its commitment to give effect to the obligations resulting from international treaties regarding human rights by changing its internal mechanisms and granting, under procedural conditions, constitutional equivalent status for internalized treaties on this matter. Those treaties not ratified through this mechanism are considered by the Brazilian Federal Supreme Court as supralegal rules. Brazil appears on the international scene as a receptive State to the normative production of international law. This is because it adheres to many treaties at the universal and regional levels on the most diverse of topics, despite complying with international soft law provisions, and also amending its domestic legislation in order to give greater focus to human rights. In this sense, Brazilian legislator includes the Federal Constitution the possibility that internationals on human rights can be imposed by Congress and, if applicable by a qualified quorum and enacted by the head of the Executive Branch, listed with the status equivalent to that of constitutional amendments. In this way, the legal system would emphasize the defense of the main values of the Brazilian Republic - respect and dignity for the human person. This article intends to approach the implications of this classification for the Brazilian legal system and for the fulfilment of Brazil's international obligations arising from treaties signed by the country, especially regarding the application of treaties by the Brazilian Judiciary. The methodology applied for this article will be jurisprudence, legislation and doctrine of domestic and international law. |

Los tratados no ratificados mediante este mecanismo son considerados por el Tribunal Supremo como normas supralegales. En la escena internacional, Brasil es un Estado receptivo a la producción normativa del derecho internacional. Esto se debe a que se adhiere a cientos de tratados a nivel universal y regional sobre un amplio abanico de temas, sin perjuicio de que acepte las disposiciones internacionales de soft law, y también modifica su legislación interna para dar mayor importancia a las cuestiones de derechos humanos. En este sentido, el legislador brasileño incluyó en los términos de la Constitución Federal la posibilidad de que los tratados internacionales en materia de derechos humanos pudieran ser analizados por el Congreso y, en caso de ser aprobados por quórum calificado y promulgados por el titular del Poder Ejecutivo, se les diera el estatus equivalente a las enmiendas constitucionales. De este modo, el sistema jurídico potenciaría la defensa de los principales valores de la República brasileña – el respeto y la dignidad de la persona humana. El artículo pretende abordar las implicaciones de esta clasificación en el ordenamiento jurídico brasileño y en el cumplimiento de las obligaciones internacionales de Brasil derivadas de los tratados firmados por el país, especialmente en lo que respecta a la aplicación de los tratados por parte del poder judicial brasileño. La metodología utilizada en el trabajo será la investigación de la jurisprudencia, la legislación y la doctrina del derecho interno e internacional.O Brasil expressa ante a sociedade internacional seu empenho em dar efetividade às obrigações resultantes de tratados internacionais com matéria de direitos humanos ao alterar seus mecanismos internos e conceder, sob condições procedimentais, status equiparado ao constitucional para acordos internalizados que versem sobre esta matéria. Já aqueles tratados não ratificados através desse mecanismo são considerados pelo Supremo Tribunal Federal como normas supralegais. O Brasil se mostra no cenário internacional como um Estado receptivo a produção normativa do direito internacional. Isto porque adere a centenas de tratados nos planos universal e regional dos mais diversos temas, não obstante acatar dispositivos internacionais de soft law, e também alterar sua legislação interna a fim de dar maior enfoque às questões de direitos humanos. Neste sentido, o legislador brasileiro incluiu nos termos da Constituição Federal a possibilidade de que os tratados internacionais sobre direitos humanos possam ser analisados pelo Congresso e, se aprovados por quórum qualificado e promulgados pelo chefe do Poder Executivo, elencados ao status equivalente ao de emendas constitucionais. Dessa forma, o ordenamento jurídico realçaria a defesa pelos principais valores da República brasileira – o respeito e dignidade à pessoa humana. O artigo tem a intenção de abordar quais as implicações desta classificação no ordenamento jurídico brasileiro e no cumprimento das obrigações internacionais do Brasil advindas de tratados firmados pelo país, especialmente no que diz respeito à aplicação dos tratados pelo Judiciário brasileiro.
