It is clear that Constitutional Amendment n. 125/2022 came to reduce the volume of cases that arrive daily at the Superior Court of Justice. It is divergent, however, which will be the reflexes on the justice system, given that the constitutional mission of this court is, if not, the last word on infra-constitutional law. To answer these questions, the present work is based on a bibliographical and doctrinal research, with a hypothetical-deductive approach, in order to understand the conception of precedent and of such court in the Constitutional State. It is concluded, therefore, that after the institution of §2° and §3° of art. 105 of the CF a new phase of the civil procedure will be inaugurated, which, in the selection of relevant cases, will translate the STJ into a true Court of Precedents, thus concerned with the respect of legal security and constitutional guarantees.
