Resumo: The article will address the topic of Brazilian criminal prosecution, focusing on the utilization of Restorative Justice within the specificity of the Agreement on Non-Prosecution of Offenses. The main objective is to explore the benefits of implementing restorative practices in the criminal justice domain. A synthesis of the so-called "Consensual Paradigm" and its underlying legal movement is presented. The article aims to explain the causes and development of this paradigm, as well as the incorporation of appropriate conflict resolution measures into the Brazilian legal framework, specifically Restorative Justice and its teleological importance within the criminal field. Subsequently, the Agreement on Non-Prosecution of Offenses is discussed, including its concept, principles, proper legal procedure, and essential characteristics. Finally, an attempt is made to answer the aforementioned guiding question by examining how Restorative Justice could be practically applied within the Agreement on Non-Prosecution of Offenses through paradigmatic cases, thus assessing the feasibility of convergence between both institutions.

Para isso, é realizado uma síntese do chamado “Paradigma Consensual” e do movimento jurídico que o sustenta. Busca-se explicar as causas de seu surgimento e desenvolvimento, bem como, sobre a inclusão das medidas adequadas de solução de conflitos no ordenamento jurídico brasileiro, mais especificamente, da Justiça Restaurativa e sua importância teleológica dentro da área criminal. Em seguida, discorre-se sobre o Acordo de Não Persecução Penal e suas particularidades, ou seja, conceito, princípios, seu devido procedimento legal e características essenciais.
