The phenomenon of work uberization arises and grows with the technological world and this is what mantains the connection between deliverymen, restaurants and customers. However, with the absence of legal legislation on this new category of work, labor between these deliverymen and delivery apps becomes uncharacterized, causing a point of discussion and doubts about if uberization will or won't harm the conditions of work. The purpose of the work is to verify the (in)existence of the relationship between them, thus analyzing all the legal requirements for there to be a labor relationship, as consequences of the social and legal aspects and to bring jurisdictions to investigate how the subject has been debated in the courts. In addition, a significant delivery survey was carried out to bring elements of the reality of these deliverymen and relate to the theorical data pointed out in the research, in order to achieve an understanding of the new area of work.
