Conciliate the use of natural resources and the so-called 'sustainable development' is no simple task. Some authors even defend that development and sustainability are antagonistic concepts. The present research has as its problematic exactly this need to reconcile these two institutes, as diverse as they are essential, when it comes to exploration of permanent preservation areas for tourist activities. Its objective is to analyze, in the State of Mato Grosso, the legislations developed and applied in order to guarantee greater protection to specially protected areas that are being used for tourist activities. The methodology used has the nature of applied research, involving local interests. The approach is deductive hypothetical and the methodological objectives are exploratory and descriptive research. The technical procedure used is that of bibliographic and documentary research - the latter based on surveys and collected data, whether from primary or secondary sources. From the research carried out, it was possible to conclude that environmental licensing is not only a necessary instrument to protect the environment, but it has also become essential for access control and regulation of the use of tourist areas with a view to providing greater protection to the public, in the face of restrictions/ limitations imposed in times of pandemic.
