This study aims to analyze the application of human rights in the Brazilian female penitentiary system. It is known that the objectives of the sanctions imposed on a delinquent are, primarily, the prevention of criminal recalcitrance and the rehabilitation of the inmate, however, the Brazilian prisons reality has been incompatible with these purposes, due to the conditions the conditions that are imposed on convicts serving sentences in the various Brazilian prisons. From this perspective, the study begins with the historical evolution of human rights in the world and in Brazil, then moving on to the concept of human rights. Subsequently, the principle and genesis of international treaties that deal with human rights and their impact on the Constitution of the Federative Republic of Brazil will be discussed. Afterwards, the legal provisions existing in the Brazilian legal system regarding the penitentiary system are analyzed, covering the types of criminal sanctions and their purposes, the principle of individualization of the sentence, the mandatory ones, the sentence fulfillment regimes, the rights guaranteed to the sentenced, as well as the convict's recovery systems during the execution of the reprimand. The reality experienced in the defined prisons is critically examined, noting that the sanction imposed on the criminal does not, in practice, constitute a real factor of recovery.
