Resumo: The analysis of the natural judge from the perspective of the provisions of international, regional and local scope, brings the capacity to understand and perceive the whole. Possible comparison between countries of Europe and America, in order to resemble its application, permeates the analysis of the scope of the sources of universal protection, of each continent and place The European and American Conventions are different on the subject, so that the second has a broader protection standard, to be observed by the Brazilian Courts. In the bias of this problem that the text develops, exposing on the one hand the resistance of the Supreme Court, regarding the commitments established in the international order and on the other the position of doctrine and the understanding manifested by the Inter-American Court.

Eventual comparação entre países da Europa e da América, com o fim de assemelhar a sua aplicação, perpassa pela análise da abrangência das fontes de proteção universal, de cada continente e local. As Convenções Europeia e Americana são díspares quanto ao tema, de forma que a segunda tem norma protetiva mais ampla, a ser observada pelos Tribunais brasileiros.
