Resumo: The main objective of this monograph is to analyze the influence of the media on society and criminal law, and how this affects issues related to legislative creation and the application of justice. Thus, the formulation of the so-called symbolic criminal law is analyzed, which, under the influence of the media, ends up generating revolt and resistance on the part of the population in general, who have the hope of doing justice to certain crimes committed, while still exercising a certain pressure on the legislature in order to create stricter criminal rules that, when applied to the specific case by the Judiciary, there is a strong symbolic charge in such rules, given that they do not fully perform their functions, as well as do not bring greater effectiveness before society, all under the argument that they were too rigid or even unconstitutional.
