Due to a major problem with overcrowding in prisons and support houses, it is necessary to understand that decriminalization can help to prevent further violence in prisons. Thus, how is the control regarding the decriminalization (regulation) of drug use? The general objective is to visualize that through the decriminalization (regulation) of drug use, indiscriminate use is not allowed. Decriminalization is needed to understand that jails are overcrowded, which, it is necessary to educate so that in the future it will avoid more arrests and more violence because of drugs and the war for drug trafficking. This research will be done through bibliographical reading carried out through study, internet site consultations, scientific articles in magazines in order to gather all the information that deal with the subject. Finally, it is concluded that the Drug Law in Brazil has undergone several changes, with a differential, in which decriminalization will not be penalized when it is for their own consumption, that is, the user cannot be arrested in the act. However, public policies are needed aiming at future problems related to the user.
