Resumo: This essay intends to discuss the hypothesis of autonomous “interest court appeal” to discuss the reasoning of court decision through “motions for clarification” with integrative effects, an institute of Brazilian law. The problem discussed concerns the current idea that the winning party does not have an appeal to appeal the decision, precisely because there was no loss of suit. Here in Brazil, the 2015 Code of Civil Procedure significantly changed the matter, precisely because, based on this legislation, the foundations of the decision are able to form a binding precedent, in addition to authorizing even the possibility of termination action in certain cases. In other words, not authorizing the plaintiff of the demand to have its own appealing interest to discuss the grounds, including to question motives and the legal basis applied, causes legal uncertainty. Therefore, the hypothesis raised is that the motion for clarification was changed to authorize this type of questioning. The method adopted is descriptive, based on deduction, and the technique of bibliographic research and case analysis were also used in their opportune moments.

O problema discutido diz respeito à ideia corrente de que a parte vencedora não detém interesse recursal para recorrer da decisão, exatamente porque não houve sucumbência. Para nós, o Código de Processo Civil de 2015 modificou sensivelmente o assunto, exatamente porque a partir desta legislação os fundamentos da decisão são aptos a formar precedente vinculante, além de autorizar inclusive a hipótese de ação rescisória em determinados casos. Ou seja, não autorizar que o autor da demanda detenha interesse recursal próprio para a discussão da fundamentação, inclusive para questionar motivos e o fundamento legal aplicado, faz com que haja insegurança jurídica. Logo, a hipótese levantada é a de que os embargos de declaração foram alterados para autorizar este tipo de questionamento.
