Resumo: The field of nanotechnology has been standing out for its potential for innovation and application in several sectors, in view of this, it is essential to establish adequate regulations that aim to provide security and create tools for the responsible development of this technology. In this way, the present work seeks to show the uses and implications of this new technology, raising questions, bringing existing data in what we can find in the literature and scientific production in a world context. Thus, the present work being of great importance for the scientific scenario, since it presents a socio-environmental character by seeking to correlate nanotechnology with possible risks to the environment and human health, in addition to presenting importance in a legal aspect, given the current gaps that the Brazilian legal system presents in relation to the theme. Having as objective the analysis and research of current rules and regulations existing in countries that are already well developed in the area of nanotechnology, bringing these norms to a debate in which it can serve for the growth and advancement of this issue in the Brazilian legal system, seeking to meet the questions of technological innovations, through investments and security for researchers, in addition to proposing a reflection on the possible risks of the issue of the environment. Thus, from the research carried out through a review article, where data from the last 8 years was used as a basis (January 2015 to May 2023) using the Scopus index with the descriptors “legislation” AND “environment ” AND “nanotechnology”, according to Boolean Logic, excluding repeated articles, book chapters and those that deviate from the theme. From the results found in the review article, we observe the great potential that nanotechnology presents, with several attributes and uses that may make a difference to society and the environment, however, it must be noted that it is still ineffective and sometimes there is no system in which we can measure the possible risks and implications that nanomaterials may bring us, whether due to risks to health and the environment, thus, it is necessary for the development and in the case of Brazil, the creation of regulatory frameworks, so that there is investment in research, which develops the country's economy, but also so that care needs are taken into account with the possible risks that may exist.

Desse modo, o presente trabalho busca mostrar os usos e implicações desta nova tecnologia, levantando questionamentos, trazendo dados existentes no que possamos encontrar na literatura e produção científica em um contexto mundial. Assim, sendo o presente trabalho de grande importância para o cenário científico, pois apresenta um caráter socioambiental por buscar correlacionar a nanotecnologia com eventuais possíveis riscos ao meio ambiente e saúde humana, além de apresentar importância em um aspecto jurídico, visto das atuais lacunas que o ordenamento jurídico brasileiro apresenta com relação a temática. Tendo como objetivo a análise e pesquisa de atuais regramentos e regulamentações existentes em países que já estão bem desenvolvidos na área da nanotecnologia, trazendo estas normativas para um debate em que possa servir para o crescimento e avanço dessa questão no ordenamento jurídico brasileiro, buscando atender as questões de inovações tecnológicas, por meio de investimentos e segurança para os pesquisadores, além de propor uma reflexão dos possíveis riscos da questão do meio ambiente. Assim, a partir da pesquisa realizada por meio de um artigo de revisão, onde utilizou-se como base os dados dos últimos 8 anos (janeiro de 2015 a maio de 2023) utilizando o índice Scopus com os descritores “legislação” AND “meio ambiente” AND “nanotecnologia”, segundo a Lógica Boleana, excluindo para tanto os artigos repetidos, capítulos de livros e os que desviassem do tema.
