Resumo: This article brings an excerpt from the doctoral thesis, which analyzes approximations between the sense of justice and Brazilian higher public education, aims to highlight the context of resistance in promoting efforts to guarantee the right to education, in the face of the subtraction of the budget public to federal universities, impacted by Constitutional Amendment (EC) n. 95/2016, a conjuncture of intensification of the anti-democratic socioeconomic political panorama, of exclusionary policy agendas to social demands. As for the methodological procedures, the qualitative research that uses the literature review, as pointed out by studies on the Brazilian public university, such as, Chauí (2001); Rossi et al. (2017); Oliveira (2018); Leher (2021) among others, in order to ratify Education as a social right, as well as Bobbio (1994), who establishes limits in the relationship between democracy and liberalism; Castells (2018) Przeworski (2020); criticize minimalist liberal democracy, and Dubet (2008), Estêvão (2004; 2015), among other authors who provide opportunities for broadening the understanding of the concept of fair in the educational institutional context. Thus, the text points to the search for articulations between the sense of social justice and the democratic processes that seek to guarantee rights to higher education.

Thus, the text points to the search for articulations between the sense of social justice and the democratic processes that seek to guarantee rights to higher education.Este artículo trae un extracto de la tesis doctoral, que analiza las aproximaciones entre el sentido de la justicia y la educación pública superior brasileña, tiene como objetivo resaltar el contexto de resistencia en la promoción de esfuerzos para garantizar el derecho a la educación, frente a la sustracción del presupuesto público a las universidades federales, impactado por la Enmienda Constitucional (EC) n. 95/2016, coyuntura de intensificación del panorama político socioeconómico antidemocrático, de agendas políticas excluyentes a las demandas sociales. En cuanto a los procedimientos metodológicos, la investigación cualitativa que utiliza la revisión de la literatura, como apuntan estudios sobre la universidad pública brasileña, como Chauí (2001); Rossi et al. (2017); Oliveira (2018); Leher (2021) entre otros, para ratificar la Educación como un derecho social, así como Bobbio (1994), quien establece límites en la relación entre democracia y liberalismo; Castells (2018) Przeworski (2020); critican la democracia liberal minimalista, y Dubet (2008), Estêvão (2004; 2015), entre otros autores que brindan oportunidades para ampliar la comprensión del concepto de equidad en el contexto institucional educativo. Así, el texto apunta a la búsqueda de articulaciones entre el sentido de la justicia social y los procesos democráticos que buscan garantizar los derechos a la educación superior.Este artigo traz um recorte da tese de doutorado, que analisa aproximações entre o sentido de justiça e a educação pública superior brasileira, tem como objetivo evidenciar o contexto de resistência na promoção de esforços para garantir o direito à educação, diante da subtração do orçamento público às universidades federais, impactadas pela Emenda Constitucional (EC) n. 95/2016, e por uma conjuntura de intensificação do panorama político socioeconômico antidemocrático, de agendas, e, de políticas excludentes às demandas sociais. Quanto aos procedimentos metodológicos, a pesquisa qualitativa que se utiliza da revisão da literatura, como apontam estudos sobre a universidade pública brasileira como, Chauí (2001); Rossi et al. (2017); Oliveira (2018); Leher (2021) entre outros, afim de ratificar a Educação como um direito social, assim como, Bobbio (1994), que estabelece limites na relação entre a democracia e o liberalismo; Castells (2018) Przeworski (2020); tecem críticas à democracia liberal minimalista, e Dubet (2008), Estêvão (2004; 2015), entre outros autores que oportunizam o alargamento da compreensão do conceito de justo no âmbito institucional educacional.
