This work, carried out under the Postgratuate Program in Juridical Sciencies , of the Center of Juridical Sciencies of Federal University of Paraiba, linked to the concentration area in Human Rights and the line Gender and Rights, takes care of maternity in prison. Therefore, problematizes up from the relationship between brazilian prison reality and instruments of defense and protection of human rights of mothers and their children in national and state context. The research is kind of documentary/bibliographic. Theorically anchors on the reflexions of two main authors: Loic Wacquant and Irving Goffman. The prison is discussed as an instrument of social control starting from the displacement of Provides-State to Penal-State. Carceral maternity is questioned while a right to be tuteleged by the State, alleged and contradictorily, its principal violator.The research is even complemented by oficial data (2003 to 2012) from National Penitentiary Department/MJ and Secretariat of Penitentiary Administration of Paraiba with no prejudice of reviewed iterature and the sudies of the legislation of Global Systems, Regional ( ONU and OEA ) and internal about the rights of maternity in prison environment. Desire to know if the violation can be justified, exclusively, by the notion of patriarcal State. The start hipotesis and the violation of the rights related to the exercise of the maternity in carcere has as a cause the sexist nature of the State, which would justify the disrespect of the national and international instruments of protection. At the end, realized that before the possibility of association of that model and disrespect to the rights of the mothers and their children to live together with dignity during the penal execution, the fact is that the brazilian prison system as much violating rights, in sex reason, as give condition of excluded of what are coated the individuals (men and women) homogenized at total institution of the universe.
