Ser mulher, mãe e presa: um estudo sobre direitos humanos e maternidade no sistema prisional

Resumo: | This work is the subject of the conclusion of the field research that took place at the Maria Júlia Maranhão Women's Re-Education Center, the only female prison in João Pessoa. This work has as its central theme a study on the relations between gender, maternity, human rights and prison system. Thus, the study aims to analyze the life trajectory and the implications of the violation of human rights, generated by the (non) exercise of motherhood of women who had and lived with their children in the prison system. To this end, we take into account recent data from the Ministry of Justice (2018) and the Penitentiary Information System - InfoPen (2018), which in recent years point to the growing number of imprisoned women who have had children within prison space. In this sense, we opted for a descriptive exploratory study, which used elements of ethnography such as participant observation and field diary. We interviewed nine women who lived with their children in prison, and methodologically built this work from the following steps: bibliographic research of the object of study, field visits, observation, surveys, and structured and semistructured interviews, which formed the data analyzed qualitatively in the study. As the results point out, we observed in the life stories narrated by the interviewees that all had their life trajectories marked by suffering and conflicting relationships in the family. In addition, some reports indicated that most women and their children were not protected and suffered serious human rights violations in prison. Some reeducated women stated that they can get in touch with their children after the separation, but assured that it is very difficult to be able to exercise motherhood while in prison. It is concluded, therefore, that it is necessary to guarantee these women and their children their rights, through access to public policies, inside and outside the prison, providing the necessary means so that they can have another perspective of life when get out of jail so that they can reestablish a healthy and safe relationship with their children, as this is their wish. |

Esse trabalho possui como temática central um estudo sobre as relações entre gênero, maternidade, direitos humanos e sistema prisional. Desse modo, o estudo tem como objetivo uma analise da trajetória de vida e as implicações da violação de direitos humanos, gerados pelo (não) exercício da maternidade de mulheres que tiveram e viveram com seus filhos (as) no sistema prisional. Para tanto, levamos em consideração os dados recentes do Ministério da Justiça (2018) e do Sistema de Informações Penitenciárias – InfoPen (2018) que apontam nos últimos anos o crescente numero de mulheres aprisionadas que tiveram filhos dentro do espaço da prisão. Neste sentido, optamos por estudo de caráter exploratório descritivo, em que foi utilizados alguns elementos da etnografia como a observação participante e o diário de campo. Entrevistamos nove mulheres que viveram com seus filhos (as) no espaço prisional, e construímos metodologicamente esse trabalho a partir das seguintes etapas: pesquisa bibliográfica do objeto de estudo, visitas ao campo, observação, levantamentos, e entrevistas estruturadas e semi-estruturadas, que formaram os dados analisados qualitativamente no estudo. Conforme apontam os resultados, observamos nas histórias de vida narradas pelas entrevistadas que todas tiveram suas trajetórias de vida marcadas pelo sofrimento e por relações conflituosas no âmbito familiar. Além disso, alguns relatos apontaram que maior parte mulheres e seus filhos (as) não tiveram seus direitos resguardados e sofreram graves violações de direitos humanos no espaço prisional. Algumas reeducandas afirmaram que conseguem ter contato com seus filhos (as) após a separação, mas asseguraram ser muito difícil poder exercer a maternidade estando presa.
