ANALYSIS OF THE OF THE WORK OF JUDGES OF THE WORKING RELATIONS OF THE BRAZILIAN STATE OF MATO GROSSO DO SUL

Resumo: Justice, value present in all societies, offers different interpretations and even contradictory ones. Under the liberal point of view, justice could be understood as a tool to guarantee the individual and collective liberties, basing on the assumption that everyone is equal under the law. Under the socialist point of view, justice and the law structure could be analysed as ideological tools of the state, besides family, school, political system based on parties, church, means of communication and culture. The judge - who possesses the knowledge of the above mentioned views on the world - can find conflicting ideological convictions and the need to enact the law, even with the awareness that the State could not possess the proper conditions, especially in the aspects of imprisonment and the principles established to re-insert the individual into society. The objective of our work is to analyse the existing relations between the meaning of work and the two aspects of suffering and pleasure in the exercise of their professions in the State of Mato Grosso do Sul. We used the qualitative study case as methodology, using the data interpretation for the analysis of the content. The results are presented into two final content analysis: the meaning of work and the construction of the identity and the suffering and satisfaction. The conclusions presented point out the meaning of work under a dialectical point of view, as well as propose suggestions for its definition.

The conclusions presented point out the meaning of work under a dialectical point of view, as well as propose suggestions for its definition.La justicia, valor presente en todas las sociedades, ofrece lecturas distintas y hasta mismo contradictorias; por la óptica liberal, la justicia se puede enteder como instrumento de garantía de las liberdades individuales y colectivas, apoyandose en el presupuesto de que todos son iguales perante la ley; en la visión de mundo socialista, la justicia y el aparato jurídico pueden ser analisados como aparatos ideológicos del estado, al lado de la família, de la escuela, del sistema político partidario, de la iglesia, de los instrumentos de información y de la cultura. El juez de derecho, conocedor de las visiones del mundo arriba explicitadas, puede entrar en conflicto entre sus convicciones ideológicas y la necesidad imperiosa de hacer cumplir la ley, mismo percebendo que el Estado puede no detener las condiciones adecuadas para tal, principalmente en lo que dice respeto a las cuestiones relativas al aprisionamiento y a los principios establecidos para la resocialización del indivíduo. Nestro estudio posee como objetivo analizar las relaciones existentes entre el significado del trabajo y el binomio sufrimiento y placer en el ejercicio profesional de los juezes de derecho sul-mato-grossenses. Como metodología de investigación privilegiamos el estudio de caso cualitativo, utilizandose para interpretación de los datos el análisis de contenido. Los resultados son presentados a través de dos categorias finales de análisis: el significado del trabajo y la construcción de la identidad y sufrimiento y placer. Las conclusiones presentadas resaltan el significado del trabajo a través de una óptica dialéctica así como proponen sugestiones para su redefinición.A justiça, valor presente em todas as sociedades, oferece leituras diferenciadas e até mesmo contraditórias; pela  ótica liberal, a justiça pode ser entendida como instrumento de garantia das liberdades individuais e coletivas, apoiando-se no pressuposto de que todos são iguais perante a lei; na visão de mundo socialista, a justiça e o aparato jurídico podem ser analisados como aparelhos ideológicos do estado, ao lado da família, da escola, do sistema político partidário, da igreja, dos instrumentos de informação e da cultura. O juiz de direito,conhecedor das visões de mundo acima explicitadas, pode entrar em conflito entre suas convicções ideológicas e a necessidade imperiosa de fazer cumprir a lei, mesmo percebendo que o Estado pode não deter as condições adequadas para tal, principalmente no que diz respeito às questões relativas ao aprisionamento e aos princípios estabelecidos para a  ressocialização do indivíduo. Nosso estudo possui como objetivo analisar as relações existentes entre o significado do trabalho e o binômio sofrimento e prazer no exercício profissional dos juízes de direito sul-mato-grossenses. Como metodologia de pesquisa privilegiamos o estudo de caso qualitativo, sendo utilizada para interpretação dos dados a análise de conteúdo. Os resultados são apresentados através de duas categorias finais de análise: o significado do trabalho e a construção da identidade e  sofrimento e prazer.
