Resumo: | This article does not deal with the international responsibility of states for non-compliance with the imperatives, including jus cogens, of public international law, but with the content of this responsibility, through positive duties to investigate, prosecute and punish these crimes in the domestic criminal justice system and its link with criminal responsibility and punishability for violations of international crimes. The key question could be formulated as follows: What would be the duty puniendi of nation-states in relation to serious violations of human rights/international crimes derived from public international law and how would this duty be articulated with the ius puniendi of the nation-state and with the general principles of criminal law, especially the principle of legality? Does the duty puniendi oblige to convert the adagium nullum crimen, nulla poena sine lege into nullum crimen, nulla poena sine iure (customary international law - ius cogens)? |

En este sentido parte del adagium nullum crimen nulla poena sine lege y cuestiona si, para evitar la impunidad, él debe se convertir en nullum crimen nulla poena sine iure (derecho internacional consuetudinário).Palabras-clave: Derechos humanos; delitos internacionales; derecho penal internacional Abstract: The article discusses the positive duty to investigate, judge and punish the international crimes of serious violations of the human rights through jus cogens. In this sense, it takes as its starting point the adage nullum crimen nulla poena sine lege and inquires if, to avoid impunity, the saying should be converted to nullum crimen nulla poena sine iure (consuetudinary international law).Keywords: Human rights; international crimes; international criminal law.Este artículo no trata de la responsabilidad internacional de los estados por incumplimiento con los imperativos, incluyendo de ius cogens, del derecho internacional público, pero del contenido de esta responsabilidad, a través de deberes positivos de investigar, juzgar y sancionar estos delitos en la justicia penal interna y su vínculo con la responsabilidad y punibilidad penal por violaciones de crimines internacionales.
