Resumo: | Most of the researches refer to the characteristic "in the workplace" as the reason for sexual harassment at work, which is imprecise. This aspect is not what defines or configures harassment. If a boss or coworker sexually harasses a worker, in the time and place of work, it is not sexual harassment at work, it is simple sexual harassment. The purposes of sexual harassment and sexual harassment at work are different, as well as their concepts, elements, modalities and responsibilities. The article seeks to really identify this figure. |

The article seeks to really identify this figure.La mayoría de las investigaciones realizadas atribuyen a la característica “en el ambiente de trabajo” la razón de ser del acoso sexual laboral, lo cual es impreciso. Este elemento no es el que define o configura dicho acoso. Si un jefe o compañero de trabajo acosa sexualmente a un/una trabajadora, en el horario y lugar de trabajo, no es acoso sexual laboral, es acoso sexual simple. La finalidad del acoso sexual y del acoso sexual laboral son distintas, así como conceptos, elementos, modalidades y responsabilidades. La presente investigación demarca el acoso sexual laboral, lo cual permite diferenciarlo del acoso sexual simple.A maioria das investigações realizadas atribuem à característica “no ambiente de trabalho” a razão de ser do assédio sexual no trabalho, o que é impreciso. Esse elemento não é o que define ou configura o assédio. Se um chefe ou colega de trabalho assedia sexualmente a um(a) trabalhador(a) no horário e local de trabalho, não é assédio sexual no trabalho, é assédio sexual simples. As finalidades do assédio sexual e do assédio sexual no trabalho são distintas, assim como seus conceitos, elementos, modalidades e responsabilidades.
