Resumo: The objective of this study was to analyze the normative and regulatory instruments of ANVISA in its regulatory action on food for athletes. To evaluate the normative action of ANVISA the research was qualitative documentary that sought the regulations on food supplements, including food for practitioners of physical activity, later called food for athletes. The research was done on the Agency's own website, where all the resolutions, Laws, Decrees and ordinances are found. For the evaluation of the inspection action of ANVISA, a query was made on the Agency's website to search for the irregular products found in the period of 5 years. In the criterion of search for irregular products, the terms 'food supplements' and 'athletes' were used. In the case of normative action, the research showed the exemption of the registration granted to the food category for athletes as the main result of successive laws over time. In the case of irregularities, 21 irregular products were evaluated, being 19 protein supplements, 1 of creatine and 1 of caffeine. Among the protein supplements analyzed, the following two irregularities stand out: detected quantity of carbohydrate superior in more than 20% to that declared in the label (11); And presence of undeclared substance on the label (9); In relation to the protein, less than 20% of that declared on the label (1) was detected, in addition to 1 product with a lower carbohydrate quantity of more than 20% when declared on the label. Another important irregularity regarding the labeling of protein supplements was the presence of undeclared substances on the label: the presence of soybean (1), cocoa (1), starch (2), corn starch (2), starch of Manioc (2) and manioc starch (3). Finally, the caffeine supplement for athletes was banned because it made irregular disclosure of therapeutic drug properties on the company's website, as well as containing the ingredient green coffee extract, classified by Resolution 16/99 as a new ingredient / novel food , Which requires registration. The research showed the importance and necessity of ANVISA's monitoring of food for athletes, especially considering the exemption of registration, which facilitates the commercialization and easy access to these products, including the Internet, combined with the stimulation of consumption within gyms and Influenced by the media. With this, more frequent monitoring actions must be carried out to ensure the effectiveness of monitoring. Only through the access to knowledge and adequate information to the consumer about the products in the market will it be possible to raise the sanitary conscience that promotes the conscious and responsible use of these products.

Para avaliar a ação normativa da ANVISA a pesquisa foi de caráter qualitativo documental que buscou as regulamentações, sobre suplementos alimentares, incluindo os alimentos para praticantes de atividade física, posteriormente chamados de alimentos para atletas. A pesquisa foi feita no próprio site da Agência, onde se encontram todas as resoluções, Leis, Decretos e portarias. Para avaliação da ação fiscalizatória da ANVISA, foi feita uma consulta no site da Agência para buscar os produtos irregulares encontrados no período de 5 anos. No critério de busca por produtos irregulares, foram utilizados os termos 'suplementos alimentares' e 'atletas'. No caso da ação normativa, a pesquisa mostrou a isenção do registro concedida à categoria de alimentos para atletas como principal resultado das sucessivas legislações ao longo do tempo. No caso das irregularidades, foram avaliados 21 produtos irregulares, sendo 19 suplementos proteicos, 1 de creatina e 1 de cafeína. Dentre os suplementos proteicos analisados, destacam-se duas seguintes irregularidades: quantidade detectada de carboidrato superior em mais de 20% ao declarado no rótulo (11); e presença de substância não declarada no rótulo (9); também foi detectado, em relação à proteína, quantidade inferior em mais de 20% ao declarado no rótulo (1), além de 1 produto com quantidade de carboidrato inferior em mais de 20% ao declarado no rótulo. Outra importante irregularidade verificada em relação à rotulagem dos suplementos proteicos foi a presença de substâncias não declaradas no rótulo: foi detectada a presença de soja (1), cacau (1), amido (2), amido de milho (2), amido de mandioca (2) e fécula de mandioca (3). Por fim, o suplemento de cafeína para atletas, teve sua distribuição proibida porque fazia divulgação irregular de propriedade terapêutica medicamentosa no site da empresa fabricante, além de conter o ingrediente extrato de café verde, classificado pela Resolução 16/99 como novo ingrediente/novo alimento, que necessita de registro. A pesquisa mostrou a importância e a necessidade do monitoramento da ANVISA sobre os alimentos para atletas, especialmente considerando a isenção do registro, que facilita a comercialização e o fácil acesso a estes produtos, inclusive pela internet, aliado ao estímulo de consumo dentro de academias e pela influência da mídia. Com isso ações de fiscalização mais frequentes devem ser realizadas para garantir a efetividade do monitoramento.
