The present work treats of the civil responsability of the professional liberal doctor towards the medical mistake and the guaranteed protection to the pacient-consumer to the Code of Defense of the Consumer. In obedience to the proposed theme, it is made a initial approach about the Code of Defense of the Consumer highlightning multiple elements e guarantees to the consumer. In sequence, it is made a explanation of how the doctor reach the diagnosis and the tecnical dificulty of the diagnosis tests in relation to the sensibility and specificity, further the own limitation of human science. From then on a concrete case in the justice that is analyzed in the light of the concepts discussed is quoted. The work was developed through bibliographical research of content extracted from books and articles published on virtual sites. At the end, it is concluded that in the face of numerous limitations of science, not always the error in the diagnosis, even with damage to the patient, is due to the negligence, recklessness or imperfection of the doctor, and thus, there is no reason for indemnity.
