LIMITACIONES INMANENTES DE LA LIBERTAD DE EXPRESIÓN. EL DISCURSO DE ODIO EN ALEMANIA, ESPAÑA Y EL TEDHResumen: Resulta controvertido si el derecho a la libertad de opinión protege afirmaciones sobre hechos, realizadas a sabiendas de que son falsas; si protege las opiniones hostiles a la Constitución o las que desconocen la dignidad humana de terceros. En algunos casos, el Tribunal Europeo de Derechos Humanos ha declarado que conductas de tal naturaleza se encuentran excluídas del ámbito de protección del derecho a la libertad de expresión. En otros casos, en lugar de tratarse de un análisis de admisibilidad, como era habitual, el test del abuso de derecho se realizó como parte de las consideraciones de fondo. Debemos determinar sí, y en qué medida, esto supone un cambio de criterio relevante, con efectos en la doctrina que ha sido aplicada por el Tribunal Constitucional español.Palabras clave: Libertad de opinión. THE HATE SPEECH IN GERMANY, SPAIN AND THE ECHRAbstract: It is controversial if the right to freedom of opinion protects statements about facts, made in the knowledge that they are false; if it protects opinions hostile to the Constitution or those that do infringe the human dignity. In some cases, the European Court of Human Rights has declared that such conduct is excluded from the scope of protection of the right to freedom of expression. In other cases, instead of being an analysis of admissibility, as usual, the test of the abuse of right was made as part of the considerations of substance. We must determine whether and to what extent this implies a change of relevant criteria, with effects on the doctrine that has been applied by the Spanish Constitutional Court.Keywords: Freedom of opinion.
