The undue occupation of non-buildable areas has subjected people who are unable to reside in the urban fabric to an unsafe and dangerous dynamic. In view of this situation, this study sought to assess how uncontrolled territorial occupation impacts road safety on a stretch of the BR349 highway, in which residences and occupations invade legally protected boundaries. The concepts used address topics such as domain strip, non-building area, longitudinal, transversal and punctual occupation. For a better understanding of the limits and competencies for management, a survey of laws and regulations that address the topic was carried out. In addition, a Road Safety Audit checklist was carried out in the studied section, which demonstrated that the highway in question does not offer safety to users, since its road elements were highly impaired due to the existing occupation and the neglect of the agencies. responsible, such as the infrastructure department of Bahia, regarding signaling, the lack of inspection of the right-ofway and the lack of resources for the maintenance of the highway. This work aims to contribute to a better understanding of the real importance of the right-ofway in terms of road safety, the fact that its use must be supervised and that the occurrence of any change must be monitored by competent authorities so that it does not harm the users.
