Feminist notes on the legal framework of the immigration and trafficking in women in Europe and Spain

Resumo: In this work, we seek to understand aspects of the legal framework of migration, trafficking in women and prostitution in Europe generally and specifically in Spain from an analysis of key regulations in force between 2005/2007 in these contexts. For this, we seek to know how the legislation and the tendency to border closures offer loopholes that lead to exploitation and vulnerability for migrant women who are exercising prostitution in Spain. We have analyzed the following documents: Protocol to prevent, suppress and punish trafficking in persons, especially women and children, in 2000, supplementing the UN Convention against international organized crime, the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the UN Convention against international organized crime and the Migration Act 1985 Spanish. The policy on trafficking in women and the more conservative positions on migration in the EU has had specific consequences for women. The treaties and laws emphasize, above all, measures of border control and repression of possible committed crimes. This perspective leaves in the background of the rights / immigrants and victims of trafficking of people (it is important to note that the texts of treaties and laws that give rise to trafficking of women identify with migration for prostitution). With regard to prostitution, the Spanish law does not penalize, but also does not regulate the practice of prostitution; makes such activity in a situation of complete illegality, which ultimately increases the vulnerability of prostitutes before abuse and exploitation of all kinds.

Para eso, buscamos conocer cómo las legislaciones y la tendencia al cierre de fronteras españolas y europeas, a través de medidas restrictivas a ese fenómeno social, ofrecen brechas que derivan en situaciones de explotación y vulnerabilidad para mujeres inmigrantes que están en España ejerciendo la prostitución. Fueron analizados los siguientes documentos: Protocolo para prevenir, reprimir y sancionar la Trata de Personas, especialmente mujeres y niños, del año 2000, que complementa la Convención de la Naciones Unidas contra la delincuencia organizada internacional; Protocolo contra el tráfico ilícito de migrantes por tierra, mar y aire, que complementa la Convención de la Naciones Unidas contra la delincuencia organizada internacional y la Ley de Extranjería de España de 1985. La política acerca del tráfico de mujeres y las posiciones más conservadoras acerca de la inmigración en la Unión Europea han tenido consecuencias específicas para las mujeres. Los tratados y leyes han enfatizado sobremanera las medidas de control de fronteras y represión de los posibles delitos cometidos. Tal perspectiva deja en segundo plano los derechos de los/las inmigrantes y de las personas víctimas del tráfico (es importante resaltar que los textos de los tratados y leyes dan pie a que se identifique tráfico de mujeres con inmigración para la prostitución). Con respecto a la prostitución, el derecho español no penaliza, pero tampoco regulariza el ejercicio de la prostitución; deja tal actividad en una situación de completa alegalidad, lo que termina por incrementar la vulnerabilidad de las prostitutas ante abusos y explotaciones de todos los tipos.Neste trabalho, buscamos compreender aspectos do marco jurídico da migração, tráfico de mulheres e prostituição na Europa de forma geral e na Espanha de forma específica a partir de uma análise das principais regulamentações vigentes entre 2005/2007 nesses contextos. Para isso, buscamos conhecer como a legislação e a tendência ao fechamento de fronteiras oferecem brechas que levam a situações de exploração e vulnerabilização para mulheres migrantes que estão na Espanha exercendo a prostituição. Foram analisados os seguintes documentos: Protocolo para prevenir, reprimir e sancionar o tráfico de pessoas, especialmente mulheres e crianças, do ano 2000, que complementa a Convenção das Nações Unidas contra a delinqüência organizada internacional; Protocolo contra o tráfico ilícito de migrantes por terra, mar e ar, que complementa a Convenção das Nações Unidas contra a delinqüência organizada internacional e a Lei de Migração espanhola de 1985. A política sobre o tráfico de mulheres e as posições mais conservadoras sobre a migração na União Européia tem tido conseqüências específicas para as mulheres. Os tratados e leis enfatizam, sobremaneira, as medidas de controle de fronteiras e repressão aos Possíveis delitos cometidos. Tal perspectiva deixa em segundo plano os direitos dos/as migrantes e das pessoas vitimas do tráfico (é importante ressaltar que os textos dos tratados e leis dão margem para que se identifique tráfico de mulheres com migração para a prostituição).
