Controlling politicians: judicial behavior, criminal control and interbranch relations at the Brazilian Supreme Court

Resumo: | Which are the possibilities of control over the political class exercised by the Brazilian SupremeCourt? How does this attribution help to explain its behavior? Having as subject the court as asphere of control of political actors, we systematize this attribution and map its potentialities, chal-lenges, and interactions with different competencies. We also identify contributions of strategicapproaches that can be promising for empirical development and differences from which we opendoors to formulate new theories and research designs. As a result, we argue that the control ofthe political class by the STF occurs in criminal and political dimensions and entails specific costsand incentives considering their institutional design and external actors. We also propose that theinteraction between attributions reveals novel facets of judicial behavior, highlighting potentialbargains, benefits, and retaliations between lawsuits with distinct institutional designs but similarsubject matters. |

Tendo como tema o tribunal enquanto esfera de controle dos políticos, o texto sistematiza essa atribuição e mapeia suas potencialidades, desafios e interações com diferentes competências. Identificam-se, também, contribuições de abordagens estratégicas frutíferas para desenvolvimento empírico, bem como diferenças a partir das quais se abrem portas para formular novas teorizações e desenhos de pesquisa. Como resultado, argumenta-se que o controle da classe política pelo STF ocorre nas dimensões criminal e política e implica cálculos de custos e incentivos próprios, considerando seu desenho institucional e os atores externos envolvidos.
