Consequences of the indefinition of the Brazilian regulatory frame: Anatel’s Consulting Council’s meetings, during the period of 1998-2003

Resumo: | The agencies of regulations in Brazil, created since 1995 in the context of the reform of the State during the first period from Fernando Henrique Cardoso (1994-1998), still search an organizational identity, so its operations, as well its respectives fields on actuations, are not well expressed in a precise way. The consultive Counsel of the Agência Nacional de Telecomunicações – Anatel proved the Agency contradictions, so the meetings of this consultive Agency resumed or reflecyed the own drama of the organization in consolidate as an politic actor. As we can observed in the article, the members of the Consultive Counsel show disinformation about the effective public responsibility from Anatel in front the process of privatizations occurred in the country from the decade of 1990 and the importance of the regularization of the Agency in front of strong economics interests came from transnational funds. The article consequently look for demonstrate the contradictions of Anatel from the perspective Counsel Consultive of the Agency. Keywords: State, society, regulation. |

Keywords: State, society, regulation.As agências de regulação no Brasil, criadas a partir de 1995 no contexto da reforma do Estado na primeira gestão de Fernando Henrique Cardoso (1994- 1998), ainda buscam uma identidade organizacional, pois suas operações, bem como seus respectivos campos de atuação – não estão definidos de forma precisa. O Conselho Consultivo da Agência Nacional de Telecomunicações - Anatel demonstra as contradições da Agência, pois as reuniões dessa instância consultiva sintetizam, ou refletem, o próprio drama da organização em consolidar-se como ator político. Como poderemos observar no artigo, os membros do Conselho Consultivo demonstram desinformação sobre a efetiva responsabilidade pública da Anatel diante dos processos de privatização ocorridos no País a partir da década de 1990 e a importância do papel regulatório da Agência diante de fortes interesses econômicos advindos do capital transnacional.
