Resumo: | The Brazilian Supreme Court (STF) has been adopting legal theses at random both in concretereview, beyond extraordinary appeals with general repercussion, and in abstract review. Apparently,the adoption of legal thesis would enable a broader scope of the adjudication process as the effectsof the decisions would bindingly expand from the original procedural limits. The goal of this paperis to explore and map the context in which legal thesis have been used in the decision-makingprocess of the STF and then to discuss the implications of this innovative practice to Brazilianinstitutional design of constitutional review. |

A adoção das teses, aparentemente, modifica a ideia tradicional de que decidir um caso concreto é diferente de decidir uma questão em tese, porque flexibiliza fronteiras processuais originais, à medida que pode expandir de forma vinculante os efeitos das decisões.
