The Federal Public Ministry as an archival authority: an analysis of the 4th CCR meeting minutes

The defense of archival heritage is included in the list of fundamental rights of collective protection, configuring a duty directed to people and institutions that are custodians of public collections. Within this scope, the Public Ministry is responsible for promoting legal instruments aimed at protecting the public and social assets, the environment, and other diffuse and collective interests. Based on this premise, this article aims to describe the role of the Public Ministry in the protection of archival heritage through qualitative and descriptive documentary research. For this, it was sought, in the minutes of the meeting of the 4th Chamber of Coordination and Review (4th CCR) of the Federal Public Ministry (MPF) for the period 2010-2019, to survey procedures related to archival themes. From the verified procedures, it was possible to evidence that the MPF's performance occurs through an investigative and recommendation bias, supported by the technical cooperation of specialized bodies such as the National Archives and the National Historical and Artistic Heritage Institute. Of the categories of procedures listed, the representations related to the preservation and conservation of files, collections tombstones, document auctions, and improper use of facilities stand out. Due to the nature of the action of the MPF, it is concluded that the agency has, to a certain degree, the status of archival authority.
