(Place) formulations: crimes, settings, puzzles and their (pratical and theoretical) outcomes and consequences

Resumo: http://dx.doi.org/10.5007/1984-8412.2017v14n1p1682Supported by the theoretical and methodological approach of Conversation Analysis (SACKS, 1992), this paper investigates transcribed audiorecorded interactions between a judge and her interlocutors during cross-examination. In particular, it analyses sequences in which, via place descriptions (or place formulations) (SCHEGLOFF, 1972), the participants negotiate intersubjectivity concerning geographical spaces (all related to where the alleged crimes took place) and about which the judge produces formulations (of understanding) (HERITAGE; WATSON, 1979). Formulations of understanding about the place descriptions show to be crucial in this context for the judge to make decisions about how to proceed in relation to the legal process in course. The analysis reveals that by means of the practice of formulation, the judge implements different actions:  (a) to raise doubts about the interlocutor’s qualification as witness on behalf of the defendant; (b) to mediate understanding between other participants in the interaction; (c) to verify the veracity of the facts presented by the interlocutor.

Más específicamente, analiza secuencias en las que, por medio de descripciones de lugar (o formulaciones de lugar) (JEFFERSON, 1974), los participantes negocian la intersubjetividad (o comprensión mutua) acerca de los espacios geográficos (donde los supuestos crímenes sucedieron) y sobre las cuales la jueza produce formulaciones (de entendimiento) (HERITAGE; WATSON, 1979). Las formulaciones de entendimiento, a partir de las descripciones de lugar, se muestran imprescindibles en este contexto para que la jueza pueda tomar decisiones sobre cómo proceder en relación con el proceso corriente. Se observa que, por medio de la práctica de la formulación, la jueza impone diferentes acciones, que son: (a) levantar dudas acerca de la calificación del interlocutor en cuanto testigo a favor del reo; (b) mediar el entendimiento entre los demás participantes de la interacción; (c) averiguar la veracidad de los hechos presentados por el interlocutor.Amparado na perspectiva teórico-metodológica da Análise da Conversa de base etnometodológica (SACKS, 1992), o artigo investiga interações, gravadas em áudio e transcritas (JEFFERSON, 1974), entre uma juíza e seus interlocutores. Mais especificamente, analisa sequências em que, por meio de descrições de lugar (ou formulações de lugar) (SCHEGLOFF, 1972), os participantes negociam a intersubjetividade (ou compreensão mútua) sobre como se configuram espaços geográficos e sobre as quais a juíza produz formulações (de entendimento) (HERITAGE; WATSON, 1979). As formulações de entendimento (a partir das descrições de lugar) mostram-se imprescindíveis nesse contexto para que a juíza possa tomar decisões sobre como proceder em relação ao processo em andamento.
